Zippy Terms & Conditions

1. Acceptance of Terms

These Terms and Conditions ("Terms") form a legal agreement between you and Mykola Bilyk, the developer of the Zippy mobile application ("Zippy," "the App," "we," "us," or "our"). By downloading, installing, or using Zippy, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

Zippy is intended for users aged 13 and older. By using the App, you represent that you meet this age requirement. If you are under 18, you should use the App only with the awareness and, where appropriate, the consent of a parent or guardian.

3. Health and Wellness Disclaimer

Zippy is intended for healthy adults and provides general wellness information only. It is not a substitute for professional medical advice. Consult your physician before beginning any fasting or dietary program.

All content in the App — including fasting schedules, calorie and macronutrient targets, water and step recommendations, scores (such as the Fat Burning Score or Protein Score), articles, and any other guidance — is provided for general informational and educational purposes only. It is generated from general formulas and publicly available research (see our Sources of Recommendations page) and is not personalized medical advice, diagnosis, or treatment.

You should not rely on the App as a substitute for consultation with a qualified physician, dietitian, or other healthcare professional, particularly if you are pregnant or breastfeeding, are under 18, have a history of eating disorders, have diabetes or another metabolic, cardiovascular, kidney, liver, or thyroid condition, are underweight, are taking prescription medication, or have any other health condition that fasting or changes in diet could affect. Stop use and consult a physician immediately if you experience dizziness, fainting, irregular heartbeat, severe fatigue, or any other concerning symptom.

You assume full responsibility for any decisions you make regarding fasting, diet, exercise, or any other activity based on information provided by the App.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Zippy on Apple-branded devices that you own or control, and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service, solely for your personal, non-commercial use.

5. Your Content

If you use the meal-photo recognition feature, you are responsible for the photos you submit. Do not submit photos containing other identifiable people without their consent, or any unlawful, offensive, or infringing content. Photos submitted for recognition are sent to a third-party AI service (Google Gemini) for analysis, as described in our Privacy Policy, and are not stored by us.

6. Subscriptions and Payments

Zippy offers optional auto-renewing subscriptions ("Zippy Plus") that unlock premium features. Current subscription options are:

  • Zippy Plus Monthly — $9.99, billed monthly
  • Zippy Plus Annual — $59.99, billed annually

Pricing may vary by region and is subject to change; the price shown at the time of purchase in the App Store controls. Any free trial period, its length, and its terms will be clearly disclosed on the purchase screen before you confirm a purchase, where applicable.

6.1 Billing and Auto-Renewal

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew for the same duration and at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. All billing is handled entirely by Apple through your App Store account; we do not process or store your payment information.

6.2 Managing or Cancelling Your Subscription

You can manage or cancel your subscription at any time through your Apple ID account settings on your device: open Settings > [your name] > Subscriptions, select Zippy, and choose Cancel Subscription. Cancelling stops future renewals but does not refund the current billing period, and you will retain access to premium features until the end of the period you already paid for. We cannot process cancellations or refunds directly, as all subscription purchases are managed by Apple.

6.3 Refunds

All purchases are billed and processed by Apple. Refund requests must be submitted to Apple, for example athttps://reportaproblem.apple.com, and are subject to Apple's refund policies. We do not have the ability to issue refunds directly.

7. Additional Terms Applicable to Apple App Store

Because Zippy is distributed through the Apple App Store, the following additional terms apply and, where they conflict with the rest of these Terms, control:

  • These Terms are between you and the Developer only, not with Apple, and Apple is not responsible for the App or its content.
  • The license granted to you is limited to use on Apple-branded devices that you own or control, and as permitted by the App Store's Usage Rules.
  • We are solely responsible for the App and its content. Apple has no obligation to furnish any maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.
  • We, not Apple, are responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • In the event of a third-party claim that the App infringes intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of such claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party agreement (e.g., your wireless data service agreement) when using the App.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

8. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by applicable law;
  • Use the App for any unlawful purpose or in violation of any applicable law;
  • Attempt to gain unauthorized access to the App's underlying systems or any third-party service integrated with the App;
  • Use the App to harass, abuse, or harm another person;
  • Circumvent or attempt to circumvent any subscription or payment mechanism.

9. Intellectual Property

The App, including its design, text, graphics, logos, and underlying code, is owned by the Developer and protected by applicable intellectual property laws. Except for the limited license granted in Section 4, no rights are transferred to you.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CALCULATION, RECOMMENDATION, OR SCORE PROVIDED BY THE APP WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR INDIVIDUAL CIRCUMSTANCES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, INCLUDING ANY HEALTH OR WELLNESS CONSEQUENCE RESULTING FROM RELIANCE ON INFORMATION PROVIDED BY THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App or your violation of these Terms, except to the extent caused by our own gross negligence or willful misconduct.

13. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App and delete it from your device at any time. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above, and, where appropriate, additional notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Ukraine, without regard to its conflict of law provisions, except to the extent superseded by applicable Apple App Store terms described in Section 7 or by mandatory consumer protection laws of your country of residence, which may also apply.
